La tutela del menor víctima de la violencia de género : marco normativo procesal y penal

The Spanish legal system provides specific protection for victims of gender violence, the paper addresses the legal situation of minors who are dependent on women victims of this type of violence. It analyses their procedural situation and, in particular, the criminal remedies for their protection. In a particular way, the aggravating circumstance of committing the act in their presence and the penalties that affect parental authority are examined.

Background: Sexual assault is a worldwide problem that has not yet been sufficiently acknowledged as confirmed by the literature. Italian law n.96, 1996, foreseeing norms regarding rape and sexual abuse, finally gave significant relevance to sex crimes. This research proposes to explore the nexus between “denied memory” or “wounded memory” and gender violence normalized in a symbolic level of production of meaning. For this respect, the following points will be analyzed: a) the perception of violence in intimate relationships of second generations post-conflict ; b) the impact of the “memory of war” on “cultural perception of violence” among generations of younger, adults and elder and between women and men of same generation. Through this work we carry out a dissertation on the phenomenon of economic violence, as a manifestation of gender violence, in the family context, and, especially, from the perspective of the divorce framework. We will analyze the harmful effects that it produces, the damage that it triggers on the most basic and essential interests of the family, and its use as a control mechanism by the aggressors. In addition to a vision of the different mechanisms that, enshrined in our legal system, serve to distort it.
